An Act Respecting the Probate Court Act and the Public Trustee Act

His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Probate Court Act

1( 1) The heading “Probate value of estate not exceeding three thousand dollars” preceding section 20 of the Probate Court Act, chapter P-17.1 of the Acts of New Brunswick, 1982, is repealed and the following is substituted:

Probate value of estate not exceeding $25,000

1( 2) Subsection 20(2) of the Act is amended by striking out “three thousand dollars” wherever it appears and substituting “$25,000”.

1( 3) Section 77 of the Act is amended

(a)  by renumbering the section as subsection 77(1);

(b)  in subsection (1) of the French version in the portion preceding paragraph a) by striking out “établir” and substituting “prendre”;

(c)  by adding after subsection (1) the following:

77( 2) Regulations made under paragraph (1)(a) may delegate a matter to or confer discretion on the Court.

Public Trustee Act

2 Subsection 7(1) of the Public Trustee Act, chapter P-26.5 of the Acts of New Brunswick, 2005, is amended

(a)  in the portion preceding paragraph a) of the French version by striking out “suffisante” and substituting “suffisantes”;

(b)  by adding after paragraph (a) the following:

(a.1)  an authentic copy of the will of the deceased, if the value of the property being held by the Public Trustee is $25,000 or less;

3 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
